🔎 What is the PSA
• The PSA was enacted in 1978 (by the then-state government in Jammu and Kashmir) — originally to curb timber smuggling.
Legally, it is a preventive-detention law: under the Act, authorities may detain a person — without formal criminal charges, trial or conviction — if they are deemed a threat to “the security of the state or maintenance of public order.”
The PSA allows detention for long periods (commonly up to two years) solely on preventive grounds.
✅ Why the (Current) Government — and Others — Are Calling to Repeal It
Recently, there is a renewed push — including from some leaders of the ruling party in J&K — to repeal PSA. Here are the key reasons:
• The government claims that PSA — a legacy law from 1978 — is outdated and “draconian,” and that its powers should not be used in a way that undermines civil liberties.
